Finexlo End User License Agreement

1. Parties

This Agreement is between you and Finexlo only, and not Apple, Inc. (“Apple”). Notwithstanding the foregoing, you acknowledge that Apple and its subsidiaries are third party beneficiaries of this Agreement and Apple has the right to enforce this Agreement against you. Finexlo, not Apple, is solely responsible for the Finexlo App and its content.

2. Privacy

Finexlo may collect and use information about your usage of the Finexlo App, including certain types of information from and about your device. Finexlo may use this information, as long as it is in a form that does not personally identify you, to measure the use and performance of the Finexlo App.

3. Limited License

Finexlo grants you a limited, non-exclusive, non-transferable, revocable license to use the Finexlo App for your personal, non-commercial purposes. You may only use the Finexlo App on Apple devices that you own or control and as permitted by the App Store Terms of Service.

4. Objectionable Content Policy

Content may not be submitted to Finexlo, who will moderate all content and ultimately decide whether or not to post a submission to the extent such content includes, is in conjunction with, or alongside any, Objectionable Content. Objectionable Content includes, but is not limited to: (i) sexually explicit materials; (ii) obscene, defamatory, libelous, slanderous, violent and/or unlawful content or profanity; (iii) content that infringes upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary right, or that is deceptive or fraudulent; (iv) content that promotes the use or sale of illegal or regulated substances, tobacco products, ammunition and/or firearms; and (v) gambling, including without limitation, any online casino, sports books, bingo or poker.

5. Warranty

Finexlo disclaims all warranties about the Finexlo App to the fullest extent permitted by law. To the extent any warranty exists under law that cannot be disclaimed, Finexlo, not Apple, shall be solely responsible for such warranty.

6. Maintenance and Support

Finexlo does provide minimal maintenance or support for it but not to the extent that any maintenance or support is required by applicable law, Finexlo, not Apple, shall be obligated to furnish any such maintenance or support.

7. Product Claims

Finexlo, not Apple, is responsible for addressing any claims by you relating to the Finexlo App or use of it, including, but not limited to: (i) any product liability claim; (ii) any claim that the Finexlo App fails to conform to any applicable legal or regulatory requirement; and (iii) any claim arising under consumer protection or similar legislation. Nothing in this Agreement shall be deemed an admission that you may have such claims.

8. Intellectual Property Claims

Finexlo acknowledges that, in the event of any third-party claim that the App infringes that third party’s intellectual property rights, Finexlo, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

9. Third Party Beneficiary

In Accordance with Section 10 of the "Instructions for Minimum Terms of Developer's End-User License Agreement" Apple and Apple's subsidiaries shall be third party beneficiaries of this End User License Agreement and - upon Your acceptance of the terms and conditions of this license agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this End User License Agreement against You as a third party beneficiary thereof.

10. Third Party Terms of Agreement

You must comply with any applicable third party terms of agreement when using the Finexlo App.

11. Legal Compliance

You represent and warrant that You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and that You are not listed on any U.S. Government list of prohibited or restricted parties.

1. Terms

By accessing the website at https://finexlo.com/, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2. Use Licence

2. This licence shall automatically terminate if you violate any of these restrictions and may be terminated by Finexlo at any time. Upon terminating your viewing of these materials or upon the termination of this licence, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Disclaimer

1. The materials on Finexlo's website are provided on an 'as is' basis. Finexlo makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
2. Further, Finexlo does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall Finexlo or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Finexlo's website, even if Finexlo or a Finexlo authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

The materials appearing on Finexlo's website could include technical, typographical, or photographic errors. Finexlo does not warrant that any of the materials on its website are accurate, complete or current. Finexlo may make changes to the materials contained on its website at any time without notice.
